All digital file sets come with an unlimited free commercial-use license included with the purchase. By purchasing this digital file set, the buyer agrees to read and adhere to the conditions that follow, and the seller agrees the buyer is entitled to the following.

Purchase of a digital file set does not signal the transfer of rights to the buyer. The design file set may not be resold to anyone, whether it be an individual or a company. All digital file sets and rights relating to them, including copyright and ownership rights in the media in which the files are stored, remain the sole and exclusive property of Nocturnn Craft, whether grouped or separated. These are unique, hand-sketched designs that were created by and digitally optimized for use by the owner of Nocturnn Craft. As such, these digital files, even after purchase and download, are protected under the Digital Millennium Copyright Act (DMCA) of 1998. This license provides the purchaser with the right to reproduce and distribute an unlimited number of finished goods only. It does not include the digital file set as a final product for distribution to any individual or company in any way on any platform.

The designs downloaded may not be sold as a paper print with this license. These designs may not be used to create products that compete with Nocturnn Craft’s products. Downloaded digital files and any parts thereof may not be sold, given away, traded, gifted, donated, nor may they be shared in any manner on any platform under any circumstances. This includes gifting, sharing, and/or selling the purchased digital files through e-mail, USB, disc, or any other method of image transfer. All file sets will contain copyright management information at the discretion of Nocturnn Craft. Unless expressly agreed upon, removing, or altering copyright information is prohibited and constitutes a direct violation of the DMCA. In such a case, the purchaser is responsible to Nocturnn Craft for any penalties and awards available under that statute.

This license grants purchaser the commercial use of downloaded file set(s) or any part thereof, in conjunction or separately, to create an unlimited number of finished products with intent to sell (wholesale or retail), distribute, gift, and/or donate. This license does not expire. No credit is necessary on the buyer’s shop (or gift) with this license.

Once purchased and downloaded with this license, do not alter, reproduce, modify, cut apart designs, or create derivative works from the design file set, or any part thereof, to make new designs for the purpose of resale. Buyer may not use Nocturnn Craft’s digital products as the main element in any of buyer’s digital designs. Buyer may not include designs purchased in bundles or any image collections for gain or charity. Color changes are allowed for multi-colored or multi-layered images.

Stencil/stamp may be created after purchase is downloaded to aid in creating products to sell, however, stencil/stamp may not be sold as a finished product. Buyer may not convert files purchased to other formats to sell. The product nor any element within may not be used to create a logo for a business.

Unless expressly stated in the listing for the digital download, design files and images may not be uploaded to Print on Demand sites, file sharing sites, nor anything similar for any purpose. This includes and is not limited to: Printful, Shopify, Redbubble, Spreadshirt, Teepublic, Zazzle, CaféPress, Society6, Printify, Spoonflower, Amazon Merch, etc.

Cut and craft files may only be used as-is, on physical end products for sale. For example:

Due to the nature of the product, returns, exchanges, refunds, or cancellations are not accepted. But please contact the owner of Nocturnn Craft if there are any problems, questions, comments, or concerns with the completed order. The goal is to provide an easy-to-use digital file one is excited to create items with. If a different file type or size is needed, do not hesitate to reach out. Nocturnn Craft operates on EST (Eastern US) time, typically at night.
